The difference between divorce and annulment

Whether you know someone personally or have heard about it through celebrity gossip, couples seeking to end their marriage by way of divorce or annulment can appear somewhat confusing. While they may seem similar, there are important distinctions between the two.

A divorce is granted by the courts when spouses decide to end a valid marriage. When the marriage is not valid, the parties may decide to get it annulled. A marriage is not valid if it could not have legally taken place.

Marriage can be deemed invalid for a variety of reasons, such as that there was lack of consent, one spouse was under the age of consent, one was already in a valid marriage, or because one was unable to consent.
