Texas Sheriff rounds up child support payments

Posted on August 13th, 2010 No Comments

The El Paso County Sheriff and the Texas Attorney General’s Child Support Division teamed up to do a sweep of parents that have a warrant out for unpaid child support.

The U.S. Border Patrol and investigators from the Child Support Division used logistical assistance to find missing parents in the county. During the sweep, 20 parents were arrested that had court orders out to pay child support.

The operation began at 4:30 a.m. when the Sheriff sent six police officials to arrest parents before they left their house in the morning. Authorities would like parents to know that they can avoid arrest by contacting the warrants section of the Sheriff’s Department.

What is an agreed divorce?

Posted on March 23rd, 2010 No Comments

An agreed divorce is a divorce between two parties, in which both parties agree to the terms of the divorce without court intervention. Agreed divorces typically take the following steps.

First, the husband and wife get together and agree on how to divide their assets and how to handle child custody issues. Once these issues are resolved, the couple visits a lawyer who drafts a legal agreement, which both parties sign.

Once this document is signed, the lawyer and couple will go to a divorce court, where the judge will ask a standard list of questions and ensure that all aspects of the agreement are in order. With the judge’s approval, the divorce will be finalized.

What is the effect of paternity establishment?

Posted on March 4th, 2010 No Comments

Once paternity is established, individuals have to fulfill certain responsibilities toward their children. These responsibilities include supporting their children financially and emotionally.

This duty has implications for a divorce because it gives both parents the right and obligation to take care of their children. This means that one parent cannot take away visitation rights if the other parent refuses to pay child support, and vice versa. When these type of problems occur, individuals should allow courts to resolve their issues and not take actions like refusing visitation.

Can the individual paying child support dictate how the payments are spent?

Posted on February 4th, 2010 No Comments

When spouses get a divorce and there are children involved, then one spouse will likely pay child support to the other spouse. The spouse paying child support may want to dictate how the payments are spent.

However, this spouse cannot control how the payments are spent for any purpose. The spouse receiving the child support typically has full discretion in regard to how to spend the payments.

Can you stop paying child support if your spouse takes away your visitation rights?

Posted on January 13th, 2010 No Comments

Even after a divorce settlement, spouses may have disputes for a variety of reasons. These disputes may cause further complications with the divorce settlement.

For instance, one spouse may choose to take away the visitation rights of the other spouse. In retribution, the other spouse may stop paying child support. This act of retribution, however, is not advised. The best remedy is to take the problem in front of a divorce judge for a legal remedy.

Some Texas Parents Struggle to Make Child Support Payments

Posted on December 3rd, 2009 No Comments

Many Texan parents are having a hard time making their child support payments and are seeking to change the terms of support arrangements.

This difficulty is partly due to the contracting economy, which is affecting men even more than it is women. The unemployment rate for men is 9.8%, compared to 7.5% for women. But for whatever reason, lawyers are reporting an increase in the number of people looking to restructure their child support payment agreements.
