Does the child have any influence on the choice of parent with who he wishes to reside?
A child twelve years of age or older may file a written election with the court, indicating which parent he would prefer to have the exclusive right to designate his residence. This is not binding on the court but it is certainly a factor that the court will give serious consideration in making its decision. The court may interview the child in chambers if the child is less that twelve to determine the child’s wishes as to which parent he would prefer to have the exclusive right to designate his residence.
