The Texas Family Code does not use the terms custody; it refers to the parents as “conservators”. Usually, the parents are appointed joint managing conservators. The person with whom the child usually resides will be granted certain exclusive rights such as the right to determine the primary domicile of the child, the right to receive child support, the right to consent to invasive surgical procedures or psychological or psychiatric treatment and certain other important life decisions for the child. The other parent is referred to as the possessory conservator and has all the rights and duties as the managing conservator except those referred to above.
