Are the parties entitled to a jury trial in a suit to modify conservatorship?
A jury trial is possible but the jury verdict is not necessarily binding on the judge if the court finds that the verdict is not supported by sufficient evidence. Court are very reluctant to contravene a jury verdict so it would almost have to be a “run a way jury” or jury nullification (ignoring the evidence) for it to be set aside.
