Family Law attorneys, child custodyWhat impact does evidence of physical abuse have on the court’s decision making as to who should be appointed a sole or joint managing conservator?

In making this determination, the court must consider evidence of intentional physical abusive force by a party against the party’s spouse, a parent of a child, or any person younger than 18 years of age committed within a two year period preceding the filing of sit or during the pendency of the suit. The court may not appoint joint managing conservators if there is credible evidence of a history of physical or sexual abuse, child abuse or neglect or sexual assault.
