In deciding conservatorship, does the court have to restrict the child’s primary residence to a particular geographical area?
The primary custodial parent has no burden to show why there should b e no domicile restriction. In determining issues of conservatorship, the best interest of the child remains the primary consideration, including whether relocation is appropriate. The court considers the effect on extended family relationships, the effect on visitation and communication with the non-custodial parent, the child’s age and existing contact with both parents.
