Smith & Garg, Child support LawIf the non-custodial parent fails to appear at the hearing on the motion to enforce, how can he be made to comply?

If the non-custodial parent fails to appear, the court may issue a capias which is the civil equivalent of an arrest warrant.  The constable or sheriff will arrest him and put him in the county jail for up to three days until he can be brought before the court.  At the hearing, the court may continue, modify or revoke the suspension and order him to serve the time.
