Smith & Garg, Child support LawWhat is the maximum amount that can be withheld from the non-custodial parent’s paycheck for child support?

Up to fifty per cent of the non-custodial parent’s income can be withheld to pay current child support, any arrearage, temporary or post divorce spousal support.  The court will sign a wage withholding order and the money will be forwarded to the State Disbursement Unit.  The State will then forward a check to the obligee.  This is to ensure timely payments are made and received and also to keep an accurate record of the payments in the event of a dispute.
