May the parties agree to modify child support orders without the court’s approval?
An order providing for child support payments may only be modified by an order signed by the court having continuing, exclusive jurisdiction over the case. Any agreements outside of the court are void and against public policy. The court’s paramount concern is always the child’s best interest and the opportunities to force the custodial parent into an agreement to take less child support present a clear and present danger to the child’s welfare.
