Smith & Garg, Child support LawIf the non-custodial parent fails to pay child support, what can be done to enforce the court’s order?

Failure to pay court ordered child support is punishable as a contempt of court.  A motion to enforce is filed with the district clerk and is served on the non-custodial parent just as any other lawsuit.  The non-payment may result in the incarceration of the non-custodial spouse, court costs and attorney’s fees levied against him.
