FAQ's

Smith & Garg, Child support LawHow are past due child support payments collected?

When the court hears the motion for contempt referred to in the preceding answer, the judge will order that the non-custodial parent not only pay the current child support every month but will also order that the arrearage or past due payments be paid.  Depending on the amount of the arrearage, the court will order that a certain percentage of the arrearage be paid each month with the current support until the arrearage is satisfied.
