If the non-custodial parent fails to pay court-ordered child support, is it permissible to withhold possession and access to the children?
Then Texas Family Code expressly prohibits withholding possession and access if the non-custodial parent is not paying child support. The Code provides for the remedy of enforcement to correct the non-payment of child support. The courts are not well disposed toward individuals exercising self-help remedies in this area. This tends to deepen whatever disputes that parties have and makes resolution more difficult.
