Child Support in the State of Texas - FAQ

Smith & Garg, child support in Texas, Family Lawyers

How does the court establish the amount of child support to be paid?

The Texas Family Code provides that child support must be calculated on a percentage of the non-custodial parent’s net resources.  Net resources is basically the amount left after Federal withholding for income tax,  Medicare, Social Security and the cost of the child’s health insurance is deducted from gross pay.  This percentage starts at twenty per cent for one child, twenty-five for two and an additional five per cent for each child, up to a maximum of fifty per cent of the available net resources.
