Child Support in the State of Texas - FAQ

Smith & Garg, child support in Texas, Family Lawyers

Does the child support obligation terminate upon the death of the obligor?

The child support obligation does not terminate upon the death of the obligor.  The court can now order that the obligor obtain and pay for a decreasing term life insurance policy in an amount sufficient to pay the balance of the child support obligation.  Most final decrees of divorce or other orders modifying child support provide that the child support obligation does not terminate upon the death of the obligor but remains an obligation of his estate.  The obligation is accelerated upon the death of the obligor and the entire amount of the unpaid future installments become immediately due and payable.
