If the non-custodial parent has additional children for whom he owes a duty of support, can the support order be modified to correct the amount being paid?
The order can be modified upon the birth of additional children as this is certainly a material change in circumstances. The Texas Family Code provides a method to determine the correct amount of support and it varies on a percentage basis, according to the number of children that the non-custodial parent has a duty to support.
