If DNA proves that the non-custodial parent is not the biological father of the child he is paying support for, may he unilaterally terminate child support payments by filing a motion to modify?
The proper procedure is usually to file a bill of review within four years of the date the order complained of was signed. He must first have the finding of parentage overturned by the court before the legal duty of support terminates. This will require genetic testing to establish that he is not the biological father.
