family law, child support modificationIf the non-custodial spouse takes a job paying less money, can he get the child support reduced?

While the best interests of the child are always the court’s paramount concern, circumstances that lead to a reduction in the non-custodial parent’s earning capacity may entitle them to reducing the child support.  If the non-custodial parent is disabled or unable to earn at the rate that child support was calculated on, it may be reduced.  However, if the custodial parent contends that the motive is intentional un-employment or under-employment, there must be evidence that the parent reduced his income for the purpose of reducing child support.
