If the non-custodial spouse has remarried, does the new spouse’s income count in the calculation of child support?
The new spouse’s income cannot be a basis for increasing the child support. However, if the new wife’s contribution to their joint living expenses reduces the none-custodial parent’s living expenses, he will be able to pay more child support. The guidelines are presumptively correct but depending on the facts of the case, the court can assess child support either more or less than guidelines.
