For parents, unless there is a standing court order, both have equal access and rights to the children. This can help to ensure that the child is in stable environment and is not being traumatized by changing living conditions too frequently.
Divorced Couples & Grandparents' Rights
Sometimes, when a couple divorces, one parent will decide to not be a part of their children's lives. This can happen for various reasons such as the parent serving jail time or they simply do not want to be a parent any more. In situations such as this, the grandparents from that side of the family may desire to spend time with the grandchildren in lieu of their own child providing the visitation. The grandparents from this side of the family can then petition for visitation from the courts. Grandparents will not be granted as much visitation as the parent would receive, however, they will likely get some time to spend with their grandchildren. This will ensure that both sets of grandparents have the rights to spend time with their grandchildren and have an equal influence. A family law lawyer can help to achieve this goal.
Whereas grandparents' rights do not automatically exist in Texas, there are instances where a family law lawyer can advise grandparents in their quest to spend quality time with their grandchildren. Grandparents can be a very important part of children's lives and they can even serve as another set of parents helping the children to grow up and be successful in their lives.
