Can other methods of alternate dispute resolution beside mediation be used in a custody dispute?
Binding and non-binding arbitration, mini-trials and informal settlement conferences are other forms available and which one is suitable depends on the particular facts of each case and the parties. Arbitration is least favored as it does not give the parties the control over the process that the other forms do. While the arbitrator’s opinion is binding on the parties, the court does not have to follow it if the judge determines that the agreement is not in the best interest of the children.
