What is mediation and what role does it play in resolving custody disputes?

Mediation is an informal proceeding that takes place outside the court room where the parties and their attorneys come together to try to resolve their disputes.  The mediator is usually a family law lawyer with considerable experience and may be chosen by the parties or appointed by the court.  The parties are in separate conference rooms and the mediator will carry proposals and counter proposals back and forth and try to help the parties resolve this issue.  Custody is a particularly sensitive issue and mediation focuses the parties’ attention on the paramount consideration-the best interests of the child.
