If the non-custodial parent simply wants to give up his rights, will the court approve an order terminating these rights?
Most courts will not terminate the non-custodial parent’s rights unless there is a step-parent ready to adopt the child. The court wants child support to be paid or at least for someone to be responsible for paying child support. The court will not approve such an order if the object is to simply avoid the child support obligation.
