If the custodial parent remarries and the new step parent wishes to adopt the child and the biological parent objects, will the court grant the adoption over the objections of the natural parent?
As always, the court’s paramount concern is the best interest of the child. A contested adoption is almost certainly more expensive and time-consuming that a non-contested proceeding. The court will order a social study of the homes of all parties, appoint an amicus attorney to represent the child and may order psychological or psychiatric examinations of all parties. The court will weigh all of these factors and the evidence developed in making its determination, including the role that the biological parent played in the child’s life, if any in making its decision.
