If the custodial parent remarries and the new step parent wishes to adopt the child, will the court then accept the biological parent’s voluntary relinquishment?
If the court determines that the adoption is in the best interest of the child, it is likely that an order of adoption world be granted. At the same time, the natural parent’s rights would be terminated and the new step-parent would literally step into the shoes of a parent and have all the same rights and duties as a natural parent. Likewise, the natural parent’s relationship with the child is legally ended.
