If a suit to terminate is filed and the party then wishes to dismiss it, can the court do so?
The suit can be dismissed without the court’s permission. If the court grants the motion to dismiss the suit, it must be without prejudice to re-file it. This means that the suit can be refilled later. Because of the serious nature of the suit, courts are more prone to closely scrutinize the facts of the case before taking any such action.
