If a trial is necessary, how does the court memorialize its findings and the division of assets and liabilities, including child support?
The lawyers will prepare a Final Decree of Divorce which will contain the court
or the jury‘s decision regarding the division of assets and liabilities. Any orders concerning possession and access to the children are included and an award of attorney’s fees and costs if that is appropriate. The court that initially takes jurisdiction of a divorce retains that jurisdiction indefinably. Any future controversies concerning property or debts, child support or custody disputes will be heard by the same court although it may not be the same judge.
