Why Contest Your Divorce? - FAQ's

Faq's

Family Law Attorney, Family Law, Contesting your divorce

How long does a contested divorce take to resolve?

This depends on the issues involved but the Texas Supreme Court has mandated that all cases should be finalized within eighteen months of filing.  Many courts will issue a scheduling order which establishes deadlines for completing discovery, designating experts, if necessary and setting the case for trial.  Generally, in district courts, the case is set for trial at any time during a two week period and is subject to being assigned to trial upon twenty four hours notice.

If there are issues such as out of town witnesses, the court may give the case a preferential setting on a certain date so that the parties and witnesses can arrange to travel if necessary.
