If the parties can’t agree on a visitation schedule for the children, how will this issue be resolved?

If the child is over the age of three years, it is presumed that the Standard Possession Order is in the best interest of the child.  The non-custodial parent would have possession of the children on the first, third and fifth weekend of every month.  They would have the option of picking the children up after school on Thursday and having possession until they return them to school Monday morning.  Otherwise, during the school year, the non-custodial parent would have the children from 6:00 p.m. until 8:00 p.m. on Thursday and from 6:00 p.m. on Friday until 6:00 p.m. on Sunday.

Children under two are dealt with somewhat differently.  Usually, there are no overnight visits until the child is eighteen months or so.  Typically, the court will start out with a few visits of a few hours each per week and gradually step up the visitation as the child gets older.
