    What is a “contested divorce”?

    In a divorce action, there are three areas that are most likely to be disputed or contested; child custody, division of assets, and division of liabilities.  Unless the parties can agree on all issues and submit an Agreed Final Decree of Divorce signed by both parties for the judge’s signature, the proceeding will be considered contested.  Few other legal proceedings are as emotionally charged as a contested divorce and depending on the causes of the divorce, the judgment of the parties can be colored leading to a hardening of each pereson's position.

    Naturally, the degree to which a particular case will be contested will vary but very few actually go to a full trial on the merits.
