If we cannot agree upon custody of the children or the division of property, how will these issues be resolved?

The jury’s verdict in custody cases is advisory, i. e. it is not binding on the judge for certain issues and he can decide to the contrary. Most courts are very respectful of jury verdicts and will decline to set them aside unless there is no evidence or insufficient evidence.
