Can the mediator order the parties to settle their case?
Neither the mediator nor the judge can order the parties to settle their case. The mediator does not act as an advocate or an arbiter; he assists the parties in reaching a settlement. The good mediators will talk to the parties about the strong and weak points of their case. This is helpful since very few people appreciate the weaknesses as much as the strengths in their cases. Ignoring the problem areas in the situation leads to a kind of self delusion making resolution more difficult.
