How important is the choice of mediator and how is that decided?
This is an important consideration since they all have different styles and personalities. Some are much more outspoken and forceful than others. In a case involving high conflict between the parties, it may be advisable to go with the stronger mediator since they are usually more inclined to be very direct in pointing out weakness in a case, whether it is a factual or legal issue. If the mediator is appointed by the court, the judge will usually ask the attorneys for suggestions. Generally, we prefer to choose the mediator since the attorneys know the case better than the judge and are in a better position to choose the appropriate person.
