Is mediation really necessary if the parties almost certainly will not agree to settle?
In most cases, the court will order the parties to mediation prior to trial. Historically, a large majority of cases settle in mediation and this has relieved the courts of considerable time and expense. Naturally, this also results in much less legal time and expense on the part of the parties too. Putting the parties into mediation also requires them to focus of the important issues rather the any personal animosity they may feel toward one another.
