Is mediation conducted in the same manner as a trial?
Mediation is a collaborative process rather than an adversarial one. There is no judge or jury, evidence is not presented and the lawyers are not there to argue. The mediator is usually a lawyer with considerable experience in the family law field. Many are retired or former judges and their insights based on years on the bench can be very useful. While the goal of mediation is the same as a trial, i.e. the resolution of the controversy, they arrive there along very different paths.
