At what stage of the divorce process is mediation appropriate?
This depends on the facts and circumstances in each case. Generally, it is more desirable to get the case into mediation as soon as possible. This greatly reduces the legal expenses and causes the parties to focus on the issues early in the case. It may be necessary to do some formal or informal discovery to determine the nature and extent of the community estate first. Otherwise, it is difficult to negotiate a fair and equitable property settlement.
