Why would the court order parties to attend mediation?
The family courts in the larger counties receive several thousand new cases each month and even with the help of an associate judge, the workload is overwhelming. Experience has shown that the vast majority of cases are resolved at mediation which takes substantial pressure off the court. The savings in legal time for the parties is likewise greatly reduced. The court cannot order a party to settle but it can order one to attend mediation in good faith and attempt to resolve the case.
