It is not a formal evidentiary process like a contested hearing or trial. However, it is helpful to the mediator who is actually putting your case to the other side to understand the nature of the proof. The party can ask the mediator not to share the evidence with the opposing party and it will remain confidential. If not, it may be advantageous for the opposing party to know what evidence will confront them at trial. This can have a significant deterrent effect, especially if that evidence is personally embarrassing to a party.

Divorce mediators are dealing with people at a time when their emotions are highly strained and they may have to approach some difficult topics.
