Can an employer fire, refuse to hire or discriminate against an employee because of a withholding order?
The Texas Family Code expressly prohibits an employer from firing, refusing to hire or disciplining an employee due to the issuance of a writ or order authorizing withholding. An employer who intentionally fires an employee for this reason is liable to the employee for current wages, benefits, attorney’s fees and court costs incurred in the enforcing the employee’s rights.
The employer may also be ordered to reinstate the employee to his position, including fringe benefits or seniority lost as a result of the termination or suspension.
