When does the obligation to pay maintenance terminate?
If awarded, three years is the maximum period that the court can order maintenance paid.
The statute requires the court to limit the duration of a maintenance order to the shortest reasonable time that allows the spouse seeking maintenance to meet their minimum reasonable needs by obtaining appropriate employment or developing an appropriate skill unless some physical or mental disability prevents this. There are additional factors that affect the duration of a maintenance order and each particular case should be reviewed by a competent family law lawyer.
The obligation also terminates upon the death of either part, the remarriage of the obligee or if the oblige cohabitates with another person in a permanent place of abode on a continuing conjugal basis.
