Can periodic payments of spousal support be withheld from the obligor’s wages?
Under certain circumstances, contractual alimony or spousal maintenance may be ordered
withheld from the disposable income of the obligor. Either the contract specifically permits withholding or the payments are not being timely made under the contract. Up to a maximum of fifty per cent of the obligor’s net resources may be withheld. If child support is also withheld, it is in the following order of priority, first current child support, secondly, current spousal support, third, child support arrearages and finally spousal maintenance arrearages.
