If a child is born during the marriage, can the husband file suit to adjudicate the parentage of the child?
The husband has standing to being such a suit although they are very rare. If he has a reasonable suspicion that the child may not be his, he can file a petition to adjudicate parentage or include the request in a divorce petition. The same procedure would be followed in such a case. All parties including the child would be required to submit to genetic testing. If the testing proves that the child is not his, he has no legal duty to support it as well as good grounds for divorce.
