Family Law Attorney, Family Law and Paternity Hearings

What are the consequences if a party fails to appear at a hearing on the petition to adjudicate parentage?

If the man has been served with the petition to adjudicate parentage and fails to appear, the court may enter a default judgment against him.  This judgment would include findings that the man is the father of the child as alleged, order child support and medical insurance payments be made by the defaulting party.  It may be difficult to set aside such an order.  If the court has ordered genetic testing and the party refuses to submit to testing, the court can enforce the order as contempt.  This includes the possibility of incarceration, assessment of attorney’s fees and costs.
