Can the parties use one lawyer to represent them both in an uncontested divorce?
We get this question fairly often and it is the policy of Smith & Garg, LLC to
decline to do so. This situation is an ethical minefield for the lawyers and creates distrust between the parties if one begins to feel that the attorney is favoring the other. The best approach in a situation where the parties are trying to keep the cost down is for the lawyer to represent one of the parties and for the other party to either retain their own counsel or at least hire an attorney to review the Final Decree of Divorce before signing it.
