Can child custody be modified following an uncontested divorce?
Child custody can be modified following an uncontested divorce just as in any other divorce. A Petition to Modify the Parent-Child relationship would have to be filed. This matter would be heard in the same court that rendered the Final Decree of Divorce or other order that adjudicated the custody of the child. The court has continuing, exclusive jurisdiction unless or until the case is transferred to a different court or a different county.
