Is child support required in an uncontested divorce?

In most cases, child support will be ordered, regardless of whether or not the divorce is contested or not. In the rare case, the court will approve a Final Decree of Divorce that doesn’t contain a child support order but only if it is in the best interest of the child.  Where both parents are affluent and the non-custodial parent agrees to place a substantial sum of money in trust for the children’s education, the court may approve such an agreement.  Ordinarily, the court requires the child support based on a percentage on the non-custodial parent’s income be paid monthly.
