If one spouse has concealed property from the other during the divorce and this is discovered, what remedy is available?
Typically final decrees of divorce provide that any such property will be either
divided equally between the parties or, the better practice is to award it to the party that it was concealed from when the final decree was entered. It would be necessary to file a motion to enforce the property division and have a hearing to obtain a ruling. The prevailing party should be awarded attorney’s fees for the preparation and hearing of the motion.
