If one party signs the Waiver of Service, will they still be entitled to their share of the community estate?
The Waiver should provide that the party signing it is not waiving any rights as to property, notice of any court proceedings or possession and access to the children. To avoid the expense and potential embarrassment of having a law enforcement officer serve the divorce papers, it is preferable to have the other party sign a Waiver of Service. This eliminates the need for personal service and can be helpful in keeping conflict to a minimum.
