What is an uncontested divorce?

A truly uncontested divorce is rare.  In most cases, the conflicts arise when the parties actually focus on the issues involved, such as division of assets and liabilities, child custody and possession and access to the children.  However, when the parties have had sufficient time to fully discuss these issues and acquire some understanding of how post divorce life will be, an uncontested divorce is infinitely preferable to a protracted struggle. 

Like any other divorce, an uncontested divorce is begun by filing an Original Petition for Divorce.  Once the Original Petition has been on file for sixty days, the parties can enter an Agreed Final Decree of Divorce.  The Decree dissolves the marriage, makes orders on child support and visitation, and divides property and liabilities between the parties.  The hearing to enter the Decree takes only a few minutes before the court and the judge will sign the Decree at that time.
