Does Texas recognize same sex marriages from other states as valid?
Generally, matrimonial proceedings conducted in other states such as divorces, child support orders, adoptions, etc are recognized in Texas due to the full faith and credit clause in the United States Constitution. These order can be registered in the district clerkâs office and enforce or modified just as any Texas order.
Massachusetts is one of the only states in America that recognizes same sex marriages or civil unions. However, the Federal Defense of Marriage Act defines marriage as a legal union between one man and one woman. This law provides an exception to the application of the full faith and credit clause and further provides that no state shall be required to recognize or give effect to any such relationship. Texas has chosen not to recognize such relationships or accord them the legal status of a marriage.
